Frequently Asked Questions (FAQ)
The partner does not pay – what is the most effective first step?
A targeted, legally substantiated demand letter leads to immediate payment in many cases. If not, it is worth quickly selecting the procedure (payment order/litigation/other).
When is a payment order a good solution?
If the claim is a monetary claim and is not expected to be seriously contested. In case of objection, it may turn into litigation, but it is often still fast.
What makes proving a claim "certain"?
Contract, proof of performance (receipt, protocol), invoices, correspondence and demand letters. Organized documentation is the greatest advantage.
How can late payment interest be enforced?
It can be calculated based on contract or law, and it is advisable to enforce it together with the claim. The correctness of the calculation and the starting date is critical.
What can be done in enforcement if there is no money in the account?
Assets, wages, receivables, real estate, vehicles – multiple enforcement methods can be considered in parallel. Much depends on targeted information gathering.
Do you also handle international claims?
Yes, also for claims within the EU, by selecting the appropriate procedural instrument.
